Public Comments: Public comments provide a forum for people’s voices to be heard in the rulemaking process. Since the 1946 Administrative Procedure Act (APA), federal law has required agencies to publish notice of proposed rules, provide an opportunity for the public to participate in the rulemaking process through public comments, and consider the “relevant matter” raised in those comments. All people (not just subject matter experts or technical specialists) are encouraged to submit public comments, as diverse information and perspectives can help agencies identify impacts they have not previously considered.

Writing public comments is an important part of the rulemaking process even when it may be unlikely that an agency will address your concerns in the final rule, because the final rule is rarely the end of the issue. Public comments are a critical part of the public record, which litigators can leverage in their arguments. Public comments can also offer unique insights about the impacts of a regulation, which agencies can use in future iterations.
